Disqualified MLA gets one more court date

Danam Nagender has moved the Supreme Court against the Telangana High Court order disqualifying him as Khairatabad MLA, according to reports. The matter is reportedly listed for September 23 before a bench headed by Chief Justice of India Surya Kant.
The High Court on September 18 set aside Assembly Speaker Gaddam Prasad Kumar’s decision, disqualified Nagender and declared the Khairatabad seat vacant. It held that the disqualification took effect from April 23, 2024, after Nagender contested the Secunderabad Lok Sabha election as a Congress candidate while being a BRS MLA. The court also refused to suspend its order while he approached the Supreme Court.
Senior Advocate Mukul Rohatgi told the Supreme Court that a by-election notification could follow. The Court listing is not a stay, and no interim protection, election notification or restoration of Nagender’s MLA status has been confirmed. The Supreme Court’s July 2025 judgment had directed the Speaker to decide defection petitions within a reasonable period. The paperwork has now reached the next counter.
