The Telangana High Court has disqualified Danam Nagender as a Telangana MLA and declared the Khairatabad Assembly seat vacant. The order takes effect from April 23, 2024 — the date Nagender filed his nomination as a Congress candidate from Secunderabad in the Lok Sabha election, after winning Khairatabad on a BRS ticket.
The court applied Paragraph 2(1)(a) of the Tenth Schedule, read with Article 191(2) of the Constitution. It also set aside the March 11, 2026 orders passed by Assembly Speaker G. Prasad Kumar. The petitioners were BRS MLA Padi Kaushik Reddy and BJP MLA Alleti Maheshwar Reddy.
The Assembly’s gazette notification declaring the vacancy was reported to have been issued on September 26, though the Gazette document itself was not available in the records reviewed. The Election Commission has not announced a Khairatabad by-election schedule. Congress had the switch; Telangana now has the vacancy.
